In the case of simple negligence in the breach of non-essential contractual obligations, the liability of KNIPEX-Werk C. Gustav Putsch KG is excluded, and in the case of negligence otherwise it is limited to the foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract and on whose observance the contractual partner may rely. However, the limitation of liability does not apply in the case of injury to life, body or health, nor in the case of the breach of a guarantee or of statutory strict (no-fault) liability.
